The Service and its original content, features, and functionality are owned by Fingal Beach Surf Life Saving Club and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The FBSLSC name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FBSLSC or its affiliates or licensors.

You must not use such marks without the prior written permission of FBSLSC. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners.

2. User Accounts

If you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

4. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason we deem fit, including, but not limited to, a breach of these Terms. We will endeavour to provide a warning for non-material breaches where appropriate.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to deactivate your account.

5. Limitation of Liability & Disclaimer

To the maximum extent permitted by applicable law, including the Australian Consumer Law, in no event shall Fingal Beach Surf Life Saving Club, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

The information and services on this Service are provided on an "as is" and "as available" basis. While we strive for accuracy, we do not warrant that the content is accurate, complete, reliable, current, or error-free. 6. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the Service, you are entitled:

• to a refund for the unused portion, or to compensation for its reduced value.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
